Shamrock
Computers, Inc. Warrants to the original purchaser only,
that the computer hardware and/or work performed will be
free of defects in workmanship and materials for a period of
Ninety (90) days from the date of delivery to the original
purchaser. This warranty covers defects encountered in the
normal use of the equipment and does not apply to the
following:

Loss
or damage to equipment resulting from abuse,
mishandling, accident of failure to follow the
operating instructions.

Defects attributable to water damage or impact
-
Equipment that has been serviced or modified by
other than our authorized service representatives.

Failure to perform reasonable and necessary
maintenance procedures.

Any
problem or corruption related to software, network
software, network software sharing, the installation
or removal of software, or any other problem related
to software installed on the computer system.

To be eligible
under this Limited Warranty, the purchaser must notify
Shamrock Computers, Inc. in writing within Ninety (90) days
from the date of delivery to the original purchaser. Such
notice must be accompanied by the original bill of sale and
should contain a brief explanation of the problem or
defect. Purchaser must, at purchaser's expense, return the
product to an authorized Shamrock Computers, inc. repair
facility. If shipped, the item returned must be properly
packaged, insured, and shipping or postage prepaid.
Shamrock
Computers, inc. reserves the right to repair or replace
defective products at its option. if a product is replaced,
the replacement shall be covered under this warranty for the
remainder of the original ninety (90) day term, or for
thirty (30) days, whichever is longer. Shamrock Computers.
Inc. retains ownership of all parts removed from repaired
products.
THE FOREGOING
WARRANTIES SUPERCEDE ALL OTHERS. THERE ARE NO OTHER
WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
USE.
In no case
shall Shamrock Computers, Inc. be liable for any special,
incidental or consequential damages based upon a breach of
warranty, breach of contract, negligence, strict tort, or
any other legal theory. Such damages include, but are not
limited to, loss of use of the product, loss of data, cost
of substitute equipment, the claims of third parties, and
injury to property.
Any action for
breach of warranty must be commenced within five (5) months
from delivery of the product to the original purchaser.
Unless
modified in writing signed by both parties, this Agreement
is understood to be the complete and exclusive Agreement
between the parties, superseding all prior agreements, oral
or written, and all other communications between the parties
relating to the subject matter of this Agreement. No
employee of Shamrock Computers, Inc. or any other party is
authorized to make any warranty in addition to those made in
this agreement.
THIS WARRANTY
GIVE YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER
RIGHTS, WHICH VARY FROM STATE TO STATE. SOME STATES DO NOT
ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR
THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL
DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT
APPLY TO YOU. |
